What’s The Case About?

Our firm, Capstone Law APC, filed a class action lawsuit on behalf of non-exempt, hourly-paid employees who worked for Party City Corporation (“Party City”) in a California location. The lawsuit, entitled Lovato v. Party City Corporation, et al., is currently pending in Solano County Superior Court, Case No. FCS041747. The lawsuit alleges the following violations against Party City:
  • not paying employees all overtime wages;
  • not paying employees California minimum wages (relating to hours worked off-the-clock);
  • not providing employees with timely, uninterrupted meal and/or rest breaks;
  • not paying employees one hour of pay as required by law for each missed meal or rest break;
  • not providing employees proper wage statements (pay stubs); and
  • not paying wages timely during employment and upon termination.

We believe that these are violations of California’s Labor Code, and we also believe that these violations occurred on a systematic basis to Party City employees.
